KOPIKO FOCUS COFFEE FREE GAS GIVEAWAY WITH PURCHASE PROMOTION

Students who purchase a pack of Kopiko® Focus Coffee will receive a free gas fill up of their vehicle for up to $70.

TERMS & CONDITIONS

1. Scope of Applicability:  Theses Terms and Conditions cover the Kopiko Focus Coffee free gas giveaway promotion by Mayora USA, Inc., a California corporation (Mayora).

2. Offers, Purchase Orders, and Order Confirmations: The offer is only valid for a limited time and is only applicable when purchasing at least one (1) blister pack of Kopiko Focus Coffee in conjunction with participants showing a valid and active student ID.  This Promotion is only available to active full time students.  The free gas is limited to filling up the vehicle the student is driving at the time the student purchases the Kopiko Focus Coffee.  A Participant may not return for the free gas at a later time. This Promotion is limited to one (1) free fill up for a student for one (1) vehicle.  A student may not receive free gas for another vehicle; and a vehicle cannot be filled with free gas more than one (1) time.  This Offer is only available at the Mobil Gas Station located at 10857 Santa Monica Boulevard, Santa Monica California (the “Mobil Gas Station”).  Limited quantities available.  First come first served and only while supplies last. No rain checks.

3. Prices and Terms of Payment: The price of Kopiko Focus Coffee will be the full retail price of $2.99 plus tax due upon completion of the purchase at the Mobil Gas Station.

4. Acceptance of Goods: Participants will be responsible for inspecting and accepting the purchased items upon completion of the sale transaction.  

5. Warranty and Return Policy:   No warranties are provided for the products provided in this Promotion.  All sales are final. No returns or exchanges.  The return of the Kopiko Focus Coffee purchased will not be accepted after the sale transaction is complete.

6. Limitations of Liability: To the maximum extent permitted by law, Participants release Mayora and Mobil Gas Station, from any liability relating to this Promotion, including, but not limited, the product acceptance, possession, use or misuse.  Mayora and Mobil Gas Station are not responsible for any damages or losses resulting from the purchase and consumption of Kopiko Focus Coffee and/or the use of the free gas.

By accepting this Promotion, each Participant agrees to and hold harmless Mayora and Mobil Gas Station and each of their affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (all of the foregoing, the “Sponsor Parties”) from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such Participant's participation in this Promotion and/or Participant’s acceptance, possession, use, or misuse of free gas; or (ii) consumption of Mayora’s products, to the maximum extent allowed by law.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, IN NO EVENT WILL MAYORA OR MOBIL GAS STATION BE LIABLE TO ANY PARTICIPANT OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF REVENUES, LOST PROFITS, LOST CAPITAL OR OVERHEAD, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WHETHER OR NOT PARTICIPANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.  Promotion Limitation.  This Promotion is subject to availability and may be suspended or terminated at any time.  Mayora and/or Mobil Gas Station have the right, at each of their sole discretion, to cancel, terminate, modify or suspend the Promotion.

8.  Final Authority.  In the event of any dispute, discrepancy or ambiguity with this Promotion, Mayora reserves the right to make the final determination regarding the application and interpretation of the Promotion.

9.  Right to Refuse.  Mayora and/or Mobil Gas Station reserve the right to refuse service to anyone.

10.  Not Transferrable.  This Promotion and offer is not redeemable for cash or transferable and void where prohibited by law.

11. Governing Law and Dispute Resolution: This agreement is governed by the laws of the state of California, without respect to conflict of law doctrines.  The venue for any dispute shall be exclusively in Los Angeles, California.

As a condition of participating in this Promotion, to the fullest extent allowed by law, Participant agrees that any and all disputes, claims, causes of action or controversies arising out of or in connection with this Promotion, shall be resolved in arbitration individually and without resort to collective, class, or aggregate action. By registering and/or submitting an Entry, each Participant irrevocably waives, to the greatest extent allowed by law, any right to seek and/or obtain rescission and/or equitable and/or injunctive relief. Further, in any such dispute, under no circumstances will Participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

12.  Entire Agreement.  These Terms and Conditions set forth the entire agreement and understanding between Mayora and Participant concerning the subject matter hereof and merges and supersedes all prior discussions, agreements, and understandings of any kind between them.  This Terms and Conditions may only be modified in writing signed by an officer of Mayora.  No employee of Mobil Gas Station has the right to modify these Terms and Conditions.

13.  Enforceability.  If any provision of these Rules is found to be invalid or unenforceable by a court of competent jurisdiction or appointed arbitrator, such determination shall in no way affect the validity or enforceability of any other provision herein.

14.  Promotion Consent.  The promotion may be filmed and photographed. Each Participant agrees that, by participating in this Promotion, Mayora and/or Mobil Gas Station may use the Participant’s name and image in any manner and in any medium for its promotional purposes without additional compensation, including, but not limited to, use of photos and/or video of Participant in commercials, print ads, social media and/or posting in a Participants’ list, except where prohibited by law.
